Parents can request an Education, Health and Care (EHC) needs assessment directly from their local authority. If the assessment is agreed, this may lead to an EHCP being issued. I can support you in preparing a strong request and gathering the right evidence.

Yes. You do not need to wait for the school. Parents and carers have the legal right to request an EHC needs assessment directly. Support with wording and evidence can significantly improve the chances of a successful application.

An EHCP should clearly describe your child’s needs (Section B), outcomes (Section E), and provision (Section F). Section F must specify exactly what support is required, how often it will be delivered, and by whom.

For an EHCP to be legally enforceable, the provision in Section F must be specific, detailed and quantified. Vague wording like “access to” or “opportunities for” is not enough to ensure support is delivered.

Yes. Parents can request changes to an EHCP at any time, and especially following an annual review. If the plan does not reflect your child’s needs or provision, you have the right to challenge it.

An annual review looks at whether your child’s EHCP is still accurate and meeting their needs. This is an opportunity to update needs, outcomes and provision. Preparation is key to making sure the right changes are made.
